Marvin Lynn Tilley, 58, was extradited from Montana to Big Horn County to face six felony sex crimes against children alleged to have taken place in the 1970s and 1980s. The Governor of Montana, Brian Schweitzer, signed an order on Nov. 6 to force Tilley’s return to Wyoming after the fugitive refused to cooperate with the extradition process.
A Big Horn County warrant for Tilley’s arrest was first filed on Aug. 7 of this year, according to court documents. 
It is alleged that Tilley did commit sexual assault in the first degree on two separate occasions in 1981 against a woman younger than 18 years of age in Deaver.
The third count listed in charging documents allege Tilley used force to have sexual intercourse in 1976 with a child who would have been under the age of 12 at the time.
Allegedly, Tilley forced a third child to perform a sex act on him in the mid-1970s.
Two additional counts of immoral acts against a child were also filed against Tilley for sex acts that allegedly occurred on at least two other occasions in the 1970s.
Tilley was arrested in the Billings area on Sept. 13 and held without bond.
According to an article in the Billings Gazette, Tilley agreed to turn himself in to authorities in early August, but had second thoughts.
Yellowstone County, Montana, records are unclear of Tilley’s whereabouts during the six weeks he was on the run except for one location where he definitely was pinpointed.
Law enforcement reports state Tilley was involved in an Aug. 16 car wreck near Douglas and was transported to a Casper hospital to be treated for three broken bones in his neck. Officials were notified and planned to arrest Tilley when he was released from the medical facility, but he was able to leave the building without the staff’s knowledge.
The case is sealed in Big Horn County and under Wyoming law authorities are not allowed to release information that could identify the victim in sexual assault cases, including the name of the accused perpetrator until the case reaches the District Court level.
Magistrate Randy Royal said before a hearing in a sealed case Monday afternoon that he could not discuss details of the case.
“I can’t confirm anything except that we are here today,” Royal said.
Staff of the circuit court clerk’s office could not reveal whether or not Tilley appeared in court for an arraignment hearing Monday, but Tilley was seen in the standard orange jail attire in the lobby accompanied by detention deputies.
